Miche Bag, LLC and Be You, LLC, the manufacturer of Shelly Bag products, have fully resolved the dispute styled Miche Bag, LLC v. Be You, LLC, Case No. 1:09-CV-1456-TLL-CEB pending in the United States District Court for the Eastern District of Michigan.
Then terms of the resolution are confidential, but in general provide that Be You will immediately cease production of its original line of Shelly Bag handbags and decorative covers. Be You is permitted to liquidate its inventory of original handbags and decorative covers until June 21, 2010. Be You may produce and sell handbags and the decorative covers after June 21, 2010, so long as such future handbags and the covers are not interchangeable with or substantially similar in shape to Miche Bag's products or otherwise covered by Miche Bag's intellectual property rights. Be You will not sell its Shelly Bag handbags or decorative covers in their original design following the June 21, 2010 deadline.
